4.2 Pricing: All prices are listed in GBP and are exclusive of VAT unless stated otherwise. We reserve the right to change prices without prior notice.

4.3 Orders: All orders are subject to acceptance and availability. We reserve the right to refuse any order without providing a reason.

8. Event Photography and Recording

8.1 Photography, video and audio recording may take place at Bioclear courses, conferences, workshops and other events. Notices will be displayed at the venue to inform attendees that photography or recording is taking place.

8.2 By accepting these Terms and booking or attending an event, you acknowledge and agree that you may appear in general, group or background photographs and recordings.

8.3 Photographs and recordings may be used by Bioclear Matrix UK Ltd and, where applicable, Bioclear Matrix Systems by Dr David Clark (“Bioclear USA”) for educational, informational and promotional purposes. This may include websites, social media, email communications, printed materials, press coverage and the promotion of future events.

8.4 You may withdraw from photography or recording at any time. Please inform the event organiser before the event or speak to a member of the Bioclear team when you arrive. You will be provided with a visible “Photography Withdrawn” identifier, which should be worn throughout the event.

8.5 We will take reasonable steps to avoid photographing or recording anyone displaying the “Photography Withdrawn” identifier and to exclude recognisable images of them from published materials.

8.6 If you later identify a published photograph or recording in which you are clearly recognisable and would prefer it not to be used, please contact support@bioclearmatrix.co.uk. Where reasonably practicable, we will remove it from future use. We may be unable to recall materials that have already been printed, distributed or shared by third parties.

8.7 We will normally request separate permission before using a posed individual photograph, interview, testimonial or other material in which an attendee is the principal subject.

8.8 Attendees must not photograph, film or record speakers, course materials, presentations, clinical content or other attendees without permission.

8.9 Our processing of photographs and recordings containing personal information is also governed by our Privacy Policy.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, Bioclear Matrix UK Ltd shall not be liable for indirect, incidental or consequential losses arising from the use of our website, products or services.

9.2 Our maximum liability in respect of a purchase shall be limited to the amount paid for the product or service concerned.

9.3 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

10. Intellectual Property

10.1 All intellectual-property rights in this website and in the Bioclear name, Bioclear Method name, logos, certification badges, course badges, photographs, videos, illustrations, graphics, templates, written materials and other artwork or resources (“Bioclear Materials”) belong to Bioclear Matrix UK Ltd, Bioclear USA and/or their respective licensors.

10.2 Nothing in these Terms transfers ownership of any Bioclear Materials to you. Bioclear Materials may only be used where we have expressly authorised their use and in accordance with Section 12.

10.3 Bioclear Materials provided as part of a course or educational programme are not automatically licensed for advertising, publication, reproduction, resale or distribution.

11. Find a Dentist Directory

11.1 The Bioclear Find a Dentist directory is a public directory intended to help patients identify clinicians who have completed specified Bioclear training.

11.2 A directory listing is not a recommendation, referral, endorsement or guarantee of a clinician’s experience, competence, services or treatment outcomes.

11.3 The clinician providing treatment is an independent dental professional and is not employed by, an agent of, or acting on behalf of Bioclear Matrix UK Ltd or Bioclear USA.

Eligibility

11.4 Only clinicians who have completed an approved certified Bioclear course are eligible for inclusion in the directory.

11.5 Attendance at an introductory course or training provided by an organisation that is not approved or formally recognised by Bioclear does not qualify a clinician for inclusion.

11.6 Eligibility and directory filters may be limited to the particular certification areas completed by the clinician, including Anterior, Posterior, Black Triangle or Rehabilitation applications.

11.7 We may request certificates, GDC or other professional registration details, or further evidence before approving or updating a listing.

11.8 A practice manager or another authorised person may submit an application on behalf of a clinician only where they have the clinician’s permission and authority to accept these Terms on their behalf.

Listing information

11.9 Applicants must provide complete, current and accurate information, including the clinician’s name, professional registration number, certifications, practice details, contact information and website address.

11.10 By submitting an application, you authorise us to use the information provided to create, publish and maintain the directory listing.

11.11 We may edit, shorten or reformat submitted information to improve its clarity, consistency and presentation.

11.12 Where requested as part of the application, we may use publicly available factual information from the clinician’s or practice’s official website to prepare original directory text. The clinician remains responsible for checking that the published listing is accurate.

11.13 Certification belongs to the named clinician and does not certify the practice, its owners or any other clinicians working at that practice.

11.14 The listed clinician or practice must notify us promptly if:

• any listing information changes;

• the clinician moves practice or stops providing Bioclear treatment at a listed location;

• the clinician’s professional registration is suspended, restricted or removed;

• any certification information is incorrect; or

• the person managing the listing no longer has authority to do so.

Professional responsibilities

11.15 “Bioclear Certified” indicates that a clinician has attended and completed one or more approved Bioclear certification courses. Certification relates only to the particular training completed and does not certify or guarantee any level of clinical skill, experience or treatment outcome.

11.16 Listed clinicians remain responsible for their own clinical care, professional decisions, advertising, regulatory compliance, indemnity and relationships with their patients.

11.17 Claims made about Bioclear, certification or treatment must be accurate, capable of substantiation and not misleading.

11.18 A clinician must not describe themselves as a specialist, expert, instructor, representative or agent of Bioclear unless they are separately entitled and expressly authorised to do so.

Directory management

11.19 We may correct, update, suspend, refuse or remove a listing where we reasonably believe that:

• the information is inaccurate, incomplete or out of date;

• eligibility or certification cannot be verified;

• a Bioclear name, logo or certification badge is being misused;

• the listing or associated advertising may mislead patients;

• the clinician or practice has breached these Terms;

• continued publication could create a legal, regulatory, patient-safety or reputational concern; or

• the directory is being changed, suspended or discontinued.

11.20 We do not guarantee that a listing will be published within a particular period, remain continuously available, appear in a particular position, receive enquiries or generate patients or revenue.

11.21 Clinicians may request removal of their listing by contacting us. We will remove it within a reasonable period, although limited information may be retained where required for legal, regulatory or administrative purposes.

12. Use of Bioclear Logos, Certification Badges and Artwork

12.1 Where we approve a clinician for the directory or otherwise provide written permission, we grant the clinician a limited, non-exclusive, non-transferable and revocable licence to use the approved Bioclear logos, certification badges and artwork supplied by Bioclear Matrix UK Ltd or Bioclear USA.

12.2 Approved materials may be used on the clinician’s or practice’s website, social-media accounts, email signature and printed patient-facing marketing only:

• in direct connection with the named certified clinician;

• at a practice where that clinician provides treatment;

• for the certification areas the clinician has completed;

• using the current artwork supplied or approved by us; and

• in accordance with any brand or usage guidelines we provide.

12.3 A practice may display a clinician’s certification badge only while that clinician works at or provides treatment from the practice. The badge must not suggest that the practice or every clinician within it is Bioclear Certified.

12.4 You must not:

• alter the wording, proportions, colours or design of any Bioclear logo, badge or artwork, other than proportionate resizing;

• combine it with another logo or create a new badge or derivative design;

• use an out-of-date or incorrect certification badge;

• remove trademark, copyright or attribution notices;

• use Bioclear Materials in a way that suggests employment, partnership, agency, endorsement, exclusivity or specialist status;

• incorporate a Bioclear name or logo into a business name, trading name, domain name, social-media handle or registered trademark;

• sell, sublicense or distribute Bioclear Materials to another person;

• use Bioclear Materials on merchandise or products for sale without written permission; or

• use course presentations, teaching materials, clinical videos or other restricted resources for advertising or public distribution unless expressly approved.

12.5 We may replace or withdraw artwork and require the use of an updated version. You must make any requested change or stop using the relevant material within the period specified by us.

12.6 Permission to use Bioclear Materials ends if the clinician is no longer eligible, the listing is removed for breach of these Terms, permission is withdrawn, or an applicable licence or directory arrangement ends.

12.7 Following the end of permission, the clinician and practice must remove the relevant Bioclear Materials from websites, social media, printed materials and other advertising within a reasonable period specified by us.

13. Directory and Artwork Charges

13.1 Applications, standard directory listings and the standard approved digital logos or artwork we supply are currently provided without charge.

13.2 We may introduce a one-off, annual or subscription charge for directory listings, enhanced listings, logo licences or additional artwork from 1 January 2027 onwards.

13.3 Before introducing a charge for an existing service, we will provide reasonable advance written notice to the email address associated with the listing. The notice will explain:

• the amount payable and whether VAT applies;

• what the charge covers;

• the payment and renewal arrangements;

• when the charge will take effect; and

• how to decline or cancel the service.

13.4 No fee will be charged retrospectively for a period during which the service was provided without charge.

13.5 We will not automatically charge an existing clinician or practice unless they have expressly agreed to the paid arrangement and authorised an appropriate payment method.

13.6 If a clinician or practice does not accept a new charge, they may cancel the relevant service without penalty. We may then remove the directory listing and/or end the associated permission to use materials covered by that service from the date stated in our notice.

13.7 We may offer free and paid levels of service with different features.

14. Submitted Content

14.1 You grant Bioclear Matrix UK Ltd a non-exclusive, royalty-free licence to use, reproduce, edit, crop, resize and display text, photographs and other content submitted for the purpose of operating and promoting the directory or relevant service.

14.2 You confirm that you have the necessary rights and permissions for all submitted content.

14.3 Clinical photographs or information capable of identifying a patient must not be submitted unless appropriate written patient consent has been obtained for the intended publication and promotional use.

14.4 You remain responsible for ensuring that submitted content does not infringe another person’s copyright, trademark, privacy, confidentiality or other rights.

14.5 You will be responsible for losses reasonably incurred by us as a direct result of your unauthorised submission or use of third-party content, misuse of Bioclear Materials or material breach of these Terms.

15. Privacy

15.1 Your use of our website and services is governed by our Privacy Policy.

15.2 Personal information collected through directory applications and listings will be processed in accordance with our Privacy Policy.

15.3 Information intended for publication—including a clinician’s name, professional registration details, qualifications, certifications, profile, practice address and practice contact information—may be publicly displayed and indexed by search engines.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising in connection with these Terms will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights applying in another jurisdiction.

17. Changes to These Terms

17.1 We may update these Terms to reflect changes to our website, directory, events, services, artwork, legal obligations or business practices. The latest version will be published on this page together with its effective date.

17.2 Where a change materially affects an existing directory listing, licence or paid service, we will take reasonable steps to notify the affected clinician or practice.

17.3 This section does not permit us to introduce or automatically collect a fee without following Section 13.
